Wills: Pour Over Wills
A Pour Over Will sets forth the wishes of the person writing the Will, the testator, that any assets he or she owns or controls at his or her death will be distributed to a trust. The Will literally dictates that the assets be "poured" into the trust from the decedent's estate. This type of Will implies that a trust is already in existence at the date of death.
As with a Simple Will and a Complex Will, a Pour Over Will must be appropriated executed.
Writing a Will does not ensure that Probate will not occur.
