Testate – Dying With a Will

If a person dies with a Will, the person died “testate”. By creating a validly executed Will prior to death, the probate process can be more efficient and streamlined and less expensive than is the process without a Will. The property the Decedent had at the time of death is used to pay expenses, taxes and creditors’ claims, and then distributed in accordance with the Decedent’s wishes as expressed in his or her Will. Having a Will allows for disposition of property that is different than the Illinois statutory scheme.
